The Member acknowledges that they have read and understood the Terms and Conditions prior to registering their user account, and further agrees to be bound by the Terms and Conditions when using the Site and its Services. 1.4 Workingholidayjobs.com.au gives no guarantee to you of the continued availability of any particular job advertised on the Site and will not be liable to you should an advertiser have filled the vacancy at any time prior to removal of the advertisement from the Site.

1.5 Access and use of this Site is limited, non-transferable and allows for the sole use of the Site by the Registered Member for personal, non-commercial purposes only for the duration of the membership. 1.6 The Member agrees to maintain confidentiality in all login and password details for their user account, and disclose details to a third party or otherwise misuse those details.

2.0 The Member hereby agrees to use the Site for the sole purpose of securing his or her employment, contributing to the Workingholidayjobs.com.au community.

2.1 Any Members making contributions deemed to be inappropriate by the management of Workingholidayjobs.com.au may have their registration terminated. The decisions of what content is inappropriate is at the sole discretion of Workingholidayjobs.com.au management. The decision made by management of Workingholidayjobs.com.auis final.

2.2 The Member confirms that their Resume / and other information uploaded to the Site are a true and accurate reflection of the Member’s employment history and training,education and that all personal details are correct and properly attributable to the Member.

2.3 The Member confirms that he or she has the right to work legally in the country he or she has applied for employment.

2.4 Being a member gives you the opportunity to receive certain benefits, discounts and offers at our partner providers. Premium Members will have the opportunity to obtain additional exclusive benefits.

2.5 Information provided on the Website, promotional materials,Facebook and all other partners is current at the time of publication However, such information and benefits may be varied at the discretion of the merchants or cease to exist. We will endeavour to keep the website and other marketing avenues up to date but can provide no guarantees this will be the case.

2.5 Paid Memberships are not Refundable

2.7 The Membership may only be used by the Member and is non-transferable. In the case of the membership being by anyone other than the member to obtain offers the merchant has the right to refuse the offer or reduce the discount.

2.8 We take no responsibility for the conduct, quality, availability or any other thing related to the benefits available from use of the Membership, this responsibility is borne exclusively by the Merchants.

2.9 We have taken all reasonable care in compiling the material in this Membership, Website, Marketing Material and arranging the benefits offered by the Membership. We make no warranties about the accuracy and completeness of any material in the Guide or Website or that the Membership or the benefits offered will attain any particular service standards, be free of defects or be fit for any particular use. We limit our liability to warranties implied by statute or otherwise to resupplying the relevant services.

2.10 All intellectual property rights used in or in connection with the Membership or any related material is owned or licensed to Bute Street PTY LTD. Under no circumstances you must not use, reproduce, modify, distribute, adapt or in any other way interfere with such intellectual property rights unless given permission prior by us.

2.11 You consent and authorize Bute Street PTY LTD to provide the information provided by you at your purchase or acceptance of possession of the Membership, and any other information provided to Bute Street PTY LTD, to any agent, contractor or Merchant of Bute Street PTY LTD for the purpose of Bute Street PTY LTD providing the benefits; marketing the Card or the Guide; and for the administration of the Membership by any third party providing such services to Bute Street PTY LTD.

2.12 If any part of these terms and conditions is, or becomes, legally invalid or unenforceable, the remainder of these terms & conditions subsists and remains enforceable.

2.13 All memberships will be auto set to recurring payments.

2.14 To unsubscribe your premium membership please do so via the “ manage your subscriptions area.

2.15 Members details maybe be passed directly onto partners to contact the member about services that will assist them throughout their journey in Australia. Ie. setting up a tax file number, learning about how the tax system works and a member of the tax team will contact you. This information will not be distributed to their partners and is held in confidence.

6.2 Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold Workingholidayjobs.com.au responsible for things other users post or do.

6.3 Advertisers are required to adhere to the Client Terms and Conditions, Workingholidayjobs.com.au will not be liable for the accuracy of any advertisement or availability of any specific job advertised on the Site.

Furthermore You also understand that Workingholidayjobs.com.au cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. ( Please email info@workingholidayjobs.com.au to terminate account). Once the request is verified the account the members account will be closed. The member will be notified that their account has been closed.

10.0 Any dispute under or arising out of this agreement shall be referred to arbitration by a single arbitrator. The arbitration shall be conducted in accordance with the rules for the Conduct of Commercial Arbitration of the Institute of Arbitrators and Mediators Australia (‘IAMA’) and subject to those rules, in accordance with the provisions of the Commercial Arbitration Act 1984 of Victoria. The parties agree and accept that the determination of the arbitration is final and binding.

11.0 All intellectual property appearing on the Site (“Intellectual Property”) are owned Workingholidayjobs.com.au, unless otherwise indicated. In using the Site, the Registered Member agrees not to infringe any Intellectual Property owned by Workingholidayjobs.com.au or any third party.

11.1 All intellectual property uploaded by the Registered Member to the Site constitutes an assignment of the intellectual property from the Member to Workingholidayjobs.com.au

12.0 Workingholidayjobs.com.au may vary these Terms and Conditions from time to time at its absolute discretion. The Member agrees to review these terms and conditions regularly.

13.0 If any part of this agreement is found to be invalid or of no force or effect under any applicable laws, executive orders or regulations of any government authority having jurisdiction, this agreement shall be construed as though such part had not been inserted herein and the remainder of this agreement shall retain its full force and effect.
